TERMS OF SERVICE

1. Acceptance of Terms

By using Rubrix-A ("the App"), whether as a Teacher, Parent or Student, you agree to these Terms of Service. These Terms form a binding agreement between you and Rajendra Patil Hunma (the "Developer"). If you are a Parent, you accept these Terms on behalf of yourself and the Student. If you do not agree, please do not use the App.

2. Purpose of the App

This App is designed to grade Student essays by providing structured feedback and analysis. The App:

• Is intended for educational use only;
• Provides advisory output only;
• Is not a substitute for teaching, teacher judgment, grading, professional discretion, or academic evaluation; and
• Does not guarantee accuracy, completeness, or academic suitability.

3. Accounts, Roles, and Authority

Parent Accounts: Parents are the account holders and licensees. Parents control access and usage by the Student.

Student Users: Students may use the App only under parental authorization and may not create independent accounts.

By using the App, Parents represent and warrant that:

• They are the legal guardian of the Student;
• They have the authority to consent to data processing on behalf of the Student; and
• They supervise and are responsible for the Student's use of the App.

4. Payments & Licensing

Subscription: Licenses valid for one year are purchased by Parents. By purchasing our App, you agree to be bound by these Terms of Service.

Restrictions: Licenses are personal, non-exclusive, and non-transferable. You may not resell, sublicense, or commercially exploit the App without prior written permission.

5. Use of Student Submissions

Students may upload their essays ("Student Submissions") for grading. Regarding these submissions:

• They are used only to provide feedback and reports.
• They are not used to train any large language model (LLM) or AI system.

Parents assume full responsibility for ensuring that Student Submissions are lawful, ensuring no prohibited or sensitive data is uploaded, and for compliance with school or institutional rules applicable to the Student Submissions.

We do not independently verify consent, authorship, or ownership and rely entirely on your representations.

6. AI Output

The App uses artificial intelligence to generate feedback and grading suggestions ("AI Output"). You acknowledge that AI systems are probabilistic and may produce errors, omissions, or biased results. Furthermore, output quality is directly influenced by the condition of scanned handwritten essays; flat pages and stable scanning practices enhance clarity and accuracy.

You acknowledge and agree that:

• AI Output is not guaranteed to be accurate or appropriate;
• AI Output must be reviewed and validated by a human; and
• You will not rely on AI Output as the sole basis for grading or academic outcomes.

The Developer is not responsible for reliance on AI Output by Students or Parents.

7. Privacy & Security

We respect Student and Parent privacy. Our Privacy Policy forms an integral part of these Terms and explains how data is handled. Please see our Privacy Policy for full details.

For Student Submissions containing personal data:

• The Parent acts as the Data Controller; and
• The Developer acts as a Data Processor, processing data only on documented instructions.

8. Acceptable Use Policy

You agree not to:

• Use the App for unlawful purposes;
• Attempt to reverse-engineer, copy, or redistribute the App;
• Circumvent licensing or security protections;
• Upload content that is defamatory, offensive, harmful, or violates student rights; or
• Upload sensitive personal data (including but not limited to health, biometric, or religious data).

9. Usage Limits and Account Restrictions

Monthly Submission Allowance: The purchase of an Annual Student License grants the User the right to submit and receive AI-generated feedback for up to five (5) essays per calendar month. This allowance is designed to support a typical student's regular study habits (e.g., one essay per week plus one revision).

Definition of a Submission: For the purposes of this limit, one "Essay Submission" is defined as a single handwritten or typed essay uploaded for analysis, resulting in the generation and download of personalised feedback. Essays are first assessed for relevance. Uploading multiple essays in one file will result in inaccurate scoring and feedback.

Reset and Rollover Policy: The monthly allowance resets automatically on the first day of each calendar month.

No Rollover: Unused essay credits do not carry over to the next month. Any credits not utilized by the end of the monthly cycle are forfeited.

Single User License & Abuse Monitoring: The Service is licensed on a per-student basis. Sharing of account credentials (username/password) to allow multiple students to utilize a single subscription is strictly prohibited. We reserve the right to monitor usage patterns. If an account exhibits activity consistent with multi-user sharing, the Developer reserves the right to suspend or terminate the account without refund.

No Circumvention: You may not attempt to bypass, mask, or evade usage limits, monitoring mechanisms, or enforcement actions. Any such attempt constitutes a material breach of these Terms.

10. Intellectual Property

The App, its design, and its features are owned by Rajendra Patil Hunma. All intellectual property rights are reserved. You may not copy, modify, or distribute the App without permission.

Student Submissions remain the property of the Student or Parent. Uploading content does not transfer ownership. By uploading Student Submissions, you grant us a limited, non-exclusive, royalty-free license to process that content solely to operate the App.

11. Updates & Availability

We may update the App to improve features, security, or compliance. We do not guarantee uninterrupted or error-free availability. Technical dependencies beyond our control may also apply to distribution, updates, and payments.

12. Disclaimer & Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

The App provides automated grading assistance but does not replace teacher judgment. We are not liable for grading outcomes, academic consequences, reputational loss, data loss, or misuse of the App. Use of the App is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnity

You agree to indemnify and hold harmless the Developer from any claims, damages, or liabilities arising from factors including, but not limited to:

• Your lack of authority or consent to upload Student Submissions;
• Misuse of AI Output;
• Violation of applicable laws or institutional policies; or
• Breach of these Terms.

15. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time.

16. Governing Law

These Terms are governed by the laws of Mauritius. Any disputes that may arise out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent Courts of the Republic of Mauritius.
